This Privacy Policy describes how RapidWay Freight collects, uses and discloses the personal data you provide through rapidway.co and the choices you have about that information. We respect your privacy and take protecting it seriously.

1. Who We Are and What This Policy Covers

This website, https://rapidway.co/ (the “Site”), is operated by RapidWay Freight (“RapidWay”, “we”, “us” or “our”), a truck dispatch and carrier services company with principal offices at 533 College Ave, Staten Island, NY 10302, USA.

This Privacy Policy explains how we collect, use, store and disclose information gathered from or provided by users of the Site, and the choices available to you. It should be read together with our Terms of Service. Capitalized terms not defined here have the meaning given in the Terms of Service.

Please read this Privacy Policy carefully. By accessing or using the Site, or by submitting information to us through it, you agree to this Privacy Policy. If you do not agree, please do not use the Site or provide us with your information.

2. Definitions

  • “Personal Data” means information that relates to an identified or identifiable natural person.
  • “GDPR” means the EU General Data Protection Regulation.
  • “CCPA” means the California Consumer Privacy Act, as amended.
  • “Affiliate” means any entity that controls, is controlled by, or is under common control with RapidWay Freight.

3. Where Our Users Are Located

The Site is intended for use by carriers, owner-operators and drivers located in the United States and Canada.

If you are in the United States, by providing Personal Data to us you consent to its processing — including collection, storage, use, disclosure, sharing and transfer — as described in this Privacy Policy.

If you are located outside the United States (other than in Canada), by providing Personal Data you consent to its transfer to the United States, or to the location of our data storage providers, and to its collection, use and disclosure in accordance with this Privacy Policy. You acknowledge that the protections afforded to your Personal Data will be those of the jurisdiction where it is held, which may differ from those of your home jurisdiction.

We do not intentionally collect Personal Data from persons in the European Union. If we learn that an EU person has provided Personal Data to us, we will handle it as described in the section “Users from the EU” below.

If you are located in Canada, this Privacy Policy as supplemented by the Canada Privacy Statement at the end of this page governs your use of the Site.

4. Scope

This Privacy Policy applies only to the Site. It does not apply to other websites, including websites operated by our Affiliates, service providers or load-board, broker and factoring partners we may link to, each of which has its own terms and privacy policy. When you follow a link away from the Site, please review the privacy policy of the site you are visiting.

5. Information You Give Us

We collect Personal Data that you provide directly, for example when you complete a form on the Site, request a callback, apply to the Lease-On Program, email us, or text us. Depending on the form, this may include:

  • Your full name, email address, phone number and mailing address
  • Your company name, MC/DOT number, authority status and home base
  • Equipment and business details such as truck and trailer type, number of trucks, years of CDL experience, ownership or financing status, and the lanes or states you run
  • For lease-on applicants: photographs of your truck, your driver’s license, truck registration, cab card or title, and the information needed to run a motor vehicle record (MVR) check
  • Your preferences about how we contact you, including your email and SMS consent choices
If you do not want us to process Personal Data about you, please do not provide it to us.

6. Information We Collect Automatically

As you navigate the Site we may automatically collect information about your device, connection and browsing activity, including:

  • General usage and tracking information such as the date and time you accessed the Site, the pages and features you viewed and how long you spent on them
  • Information from your browser and our server logs, such as your IP address, device and operating system, browser type and version, referring addresses and other server log data

We may also collect information automatically when you interact with our advertising on third-party websites and services, where that advertising links to this Privacy Policy.

We process this data on the basis of our legitimate interest in understanding how the Site is used, improving it, and measuring our marketing. If you do not want us to collect information from your computer or mobile device, please do not use the Site.

7. How We Use Your Information

We use the information we collect about you, including Personal Data, to:

  • Evaluate whether we can work together — for example, reviewing a dispatch request or a Lease-On Program application
  • Provide the information, products and services you ask for, including dispatch, compliance, accounting and lease-on services
  • Communicate with you about your request, your account, your loads and our services, by phone, email and (with your consent) text message
  • Tell you about RapidWay programs, services and offers we believe may interest you
  • Notify you about changes to the Site, this Privacy Policy or our Terms of Service
  • Operate, maintain, secure and improve the Site, and present it and its content to you
  • Aggregate and analyze usage so we can understand our audience and improve what we offer
  • Comply with legal obligations, enforce our Terms of Service, protect the safety and integrity of our users, employees, the public and the Site, and investigate or report abuse
  • Fulfil any other purpose you consent to, or that we describe when you provide the information

We do not sell your Personal Data. A “sale” under the CCPA is defined broadly to include renting, releasing, disclosing or otherwise making Personal Data available to another business for monetary or other valuable consideration. We do not do this. If we ever transfer the Site or our business, we will give you notice so you can object to your Personal Data being transferred with it, and will delete it beforehand if you do.

8. When We Share Information

We may share your Personal Data with:

  • Our Affiliates, so they can use it for RapidWay’s business purposes, including evaluating whether we can work together
  • Brokers, shippers and load boards, to the extent needed to book and manage loads on your behalf once you are a RapidWay carrier — for example, your name, phone number, MC/DOT number, equipment type and location
  • Insurance providers, factoring companies, fuel-card and ELD providers that you ask us to set up or that are part of a program you join
  • Professional advisers, including lawyers, bankers, auditors and insurers
  • Government bodies and regulators, including the FMCSA and DOT, where required to report or verify compliance
  • Successors in the event of a merger, acquisition, restructuring, dissolution or other transfer of some or all of our business or assets

We require every third party we share your data with to keep it secure and to treat it in accordance with the law. They may process your Personal Data only for specified purposes and on our instructions. If we learn a third party is using or disclosing Personal Data contrary to this Privacy Policy, we will take reasonable steps to stop it and to have the data deleted, anonymized or returned.

Except as described in this Privacy Policy, we will not disclose your information to unaffiliated third parties without your express consent.

9. Service Providers

We use third-party companies, individuals and our own Affiliates (“Service Providers”) to host and operate the Site, provide related services, collect information, send and respond to email and text messages, run background and MVR checks, process settlements, and help us analyze how the Site is used.

Service Providers have access to your Personal Data only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.

10. Cookies and Tracking Technologies

We use cookies and similar technologies to recognize returning visitors and understand how the Site is used. A cookie is a small data file, usually containing an anonymous unique identifier, that a website sends to your browser and stores on your device. Most browsers let you refuse cookies; if you do, some features of the Site may not work.

Strictly necessary cookies are required to navigate the Site and operate its basic functions, such as remembering your cookie preferences or submitting a form. They are always active and cannot be disabled.

Statistics cookies collect aggregated, anonymous information about how visitors use the Site — browser, operating system, pages visited, time on site, errors encountered — so we can evaluate and improve it. We do not use these cookies to identify you personally.

We may also use marketing cookies set by advertising platforms to measure our campaigns and show RapidWay ads to people who have visited the Site. You can decline all cookies other than strictly necessary ones in your browser settings, or opt out of individual platforms using the links below.

Cookies on the Site may be set by us (first-party cookies) or by third-party services we use, which currently may include:

  • Google Ads — measuring ad campaigns and showing our ads to people who have interacted with the Site. Ad settings

11. Security

We maintain administrative, technical and physical safeguards designed to prevent unauthorized access, disclosure, loss, misuse or destruction of the data you provide to us. Documents submitted for lease-on applications, such as licenses and registrations, are stored with restricted access and are used only for onboarding and compliance.

No method of transmission over the Internet or of electronic storage is completely secure. Although we work hard to protect your information, we cannot guarantee the security of information exchanged through the Site, and we disclaim any assurance that it will remain absolutely secure.

12. Children

The Site is not directed to, or intended for use by, anyone under the age of eighteen (18), and we do not knowingly collect Personal Data from anyone under that age. If we learn that a person under 18 has provided us with Personal Data through the Site, we will delete it from our records as quickly as reasonably possible.

13. Users from the EU

If you are located in the European Union you may have additional rights under the GDPR and your local law, including:

  • Right of access — to confirm whether we are processing your Personal Data and, if so, which categories, for what purposes, with whom it has been or will be shared, and for how long it will be kept
  • Right to object — to processing based on our legitimate interests, in which case we will stop unless we can show compelling legitimate grounds that override your interests, rights and freedoms, or the processing is needed for legal claims. You may object to direct marketing at any time, regardless of any consent given earlier
  • Rights to restriction, portability, rectification and erasure of your Personal Data, where applicable

If you believe our processing of your Personal Data does not comply with applicable data-protection law, you may contact us at onboard@rapidway.co or lodge a complaint with your competent supervisory authority; contact details for EU data protection authorities are available from the European Data Protection Board.

14. Data Retention and Deletion

We keep Personal Data for as long as you use the Site, work with RapidWay, or continue communicating with our team, and for as long afterwards as is needed for the purposes it was collected for.

When deciding how long to keep data we consider its amount, nature and sensitivity, the potential risk of harm from unauthorized use or disclosure, the purposes of processing and whether they can be met in other ways, and applicable legal requirements. Carrier, settlement and tax records are retained for the periods required by federal and New York law — generally at least three years after the end of our relationship — and lease-on and driver qualification files for the periods required by FMCSA regulations.

We may anonymize and aggregate Personal Data for research or statistical purposes, in which case we may use, disclose and keep that information indefinitely without further notice.

15. Keeping Your Information Up to Date

By agreeing to this Privacy Policy you agree to keep the contact details and other Personal Data we hold about you accurate. If anything changes, please contact us at onboard@rapidway.co with enough detail for us to update your record.

16. Do Not Track Signals

“Do Not Track” (DNT) is a preference you can set in your browser to tell websites you do not want your activity tracked. The Site does not currently respond to DNT or similar signals.

17. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will post the revised policy on this page with a new effective date, and may add a notice on the Site’s home page for significant changes. Your continued use of the Site after a change means you accept the updated policy, including its application to information collected before and after the effective date. Please check back periodically.

19. SMS Consent and Communication

Phone numbers collected through our SMS consent process are used only to communicate with you about RapidWay Freight services. They are never shared with or sold to third parties for their marketing purposes.

20. Message Frequency

Message frequency varies with the type of communication and how actively you are running with us. A driver under dispatch can expect several messages a day about load offers, confirmations and check calls; a driver who has only requested information will hear from us far less often.

21. Fees for SMS Messaging

Standard message and data rates may apply, depending on your carrier’s pricing plan. Rates may differ for messages sent domestically or internationally.

22. Opt-In, Opt-Out and Help

You may opt in to receive SMS messages from RapidWay Freight:

  • Verbally, during an in-person conversation
  • Verbally, during a phone conversation
  • By submitting one of the forms on our Site and checking the SMS consent box
  • By sending us an email asking to be added

You can opt out at any time by replying STOP to any message you receive, or by contacting us directly and asking to be removed from our messaging list.

If you need assistance, reply HELP to any message, or email us at onboard@rapidway.co.

If you do not wish to receive SMS messages, simply leave the SMS consent box on our forms unchecked. Consent to receive texts is not a condition of using our services.

23. Types of Messages You Can Expect

By opting in to our messaging service, you agree to receive communications related to our dispatch, compliance and lease-on services, including but not limited to:

Load offers and availability requests

Details about available loads, including pick-up and delivery locations, dates, load specifications and rates.

Example: “Hello, this is Ethan with RapidWay Freight. I found a reefer load picking up in Laredo, TX tomorrow as you asked. Call me back when you are available. Reply STOP to opt out of SMS messaging at any time.”

Load confirmations and updates

Notifications about load acceptance, rate confirmations and real-time updates, including ETA requests and tracking links.

Example: “Hello, thank you for booking a load with RapidWay Freight. Please follow the link to activate tracking while you are under the load. Reply STOP to opt out of SMS messaging at any time.”

Special instructions

Customer-specific instructions such as securement or photo requirements, or a request to contact the shipper directly.

Example: “Hello, please send a picture of the loaded trailer before you leave the shipper. Reply STOP to opt out of SMS messaging at any time.”

Status and availability inquiries

Requests for your current location, delivery status, or planned availability.

Example: “Hello, checking on the delivery status of the load. Reply STOP to opt out of SMS messaging at any time.”

Account and billing notices

Settlement notices, paperwork reminders and compliance deadlines connected to your account.

By continuing to use our services you acknowledge and consent to receiving these types of messages as part of service delivery. To opt out, follow the instructions in any message or contact us at onboard@rapidway.co.

Supplement

Canada Privacy Statement

1. Scope

This Canada Privacy Statement (the “Statement”) applies if you are located in Canada. It sets out the particular privacy principles RapidWay Freight follows for Personal Data collected from individuals in Canada, in any format, and operates together with the Privacy Policy above. Where this Statement and the Privacy Policy are inconsistent, this Statement governs the collection, use and disclosure of Personal Data from individuals in Canada.

2. Definitions

Capitalized terms have the meanings given in the Privacy Policy. In addition, “Agent” means any party that collects or uses Personal Data on our instructions and solely for us, or to which we disclose Personal Data for use on our behalf.

3. Consent for Collection, Use and Disclosure

We collect the Personal Data described in the section “Information You Give Us” of the Privacy Policy, and may collect information automatically as described in “Information We Collect Automatically”. By providing Personal Data to us you consent to its processing as described in this Statement and the Privacy Policy.

We identify the purposes for collecting Personal Data at or before the time it is collected, tell you about any choices you have to limit its collection, use or disclosure, and give you reasonable ways to exercise those choices. We will not collect, use or disclose your Personal Data without your informed consent unless the law requires or permits it, and will use it only for the purposes it was collected for unless you later consent otherwise.

We may share your Personal Data with the parties listed in “When We Share Information” in the Privacy Policy, and with Agents acting on our behalf. We require every Agent and third party to safeguard Personal Data consistently with this Statement and applicable privacy law, obtain written assurances to that effect before transferring data, and take reasonable steps — including seeking deletion, anonymization or return of the data — if we learn of a use contrary to this Statement.

RapidWay Freight is based in New York, in the United States. Personal Data may therefore be processed, used, stored or accessed in the United States and be subject to United States law, including lawful requests from government authorities, courts or law enforcement there, as well as to Canadian privacy legislation such as the Personal Information Protection and Electronic Documents Act (“PIPEDA”).

4. Security

We maintain safeguards designed to prevent unauthorized disclosure, loss, misuse or destruction of your data. Because no method of Internet transmission or electronic storage is completely secure, we cannot guarantee the security of information exchanged through the Site.

5. Data Integrity

We use Personal Data only in ways compatible with the purposes for which it was collected or that you later authorize, and take reasonable steps to ensure it is relevant, accurate, complete and current.

6. Access

You may contact us at onboard@rapidway.co to confirm whether we are processing your Personal Data; if we are, we will tell you which categories, for what purposes, with whom it has been or will be shared and for how long it will be kept, and will take reasonable steps to let you correct, amend or delete information shown to be inaccurate or incomplete.

7. Governing Law and Dispute Resolution

This Statement, and the use of Personal Data under it, are governed solely by the laws of the Province of Ontario and the federal laws of Canada applicable there, including PIPEDA, excluding any conflict-of-law rules that would apply other laws.

We will investigate and try to resolve complaints and disputes about the collection, use and disclosure of Personal Data in accordance with this Statement. Any claim or cause of action relating to this Statement or our handling of your Personal Data must be commenced within six (6) months after it arises, or as limited by applicable law, after which it is barred.

8. Changes to This Statement

We may change this Statement from time to time and will post notice of changes on this page. Your continued use of the Site after a change means you accept the updated Statement.
